Lovements Terms of Use
Version 1.6 · Effective date: August 28, 2026
1. General provisions and acceptance
Lovements ("Service") is a private app for keeping a closed family album of a child's photos, videos, and milestones and sharing it with invited relatives. The Service is operated by Sole Proprietor (FOP) Kostiantyn Ivanov, Ukraine ("we", the "Operator").
By using the Service, you confirm that you have read these Terms of Use ("Terms") and the Privacy Policy and that you agree to them. If you do not agree, please do not use the Service.
We may change these Terms. We will notify you of material changes in the app and/or by email; the amended version takes effect when published (or on another stated date). Continued use means acceptance of the changes.
2. Who may use the Service
- The Service is intended only for adults (18+).
- Children do not register and do not use the Service themselves. A child's data is entered by their parent or legal guardian, who consents to its processing (see the Privacy Policy, "Children's data" section).
- Registration by legal entities is not provided for without our separate consent.
- You agree to provide accurate information at registration and to keep it up to date.
3. Account and security
- Roles: administrator (creates and manages the album, invites members) and viewer (invited to view the album and react).
- You are responsible for keeping your password safe and for all activity in your account. Do not transfer or lend your account to third parties.
- The administrator is responsible for the people they invite and for properly managing access to their album.
- Report any unauthorized access to your account immediately to [email protected].
4. How the Service works
- The administrator creates a private album, uploads photos/videos and milestones, and invites a limited circle of relatives.
- Invitations use personal invite codes. The album has no public links and is not indexed by search engines.
- You may invite only family members or close persons whom the administrator trusts to view the child's content.
- We may set or change limits on the number of album members and other technical limits of the Service.
- We may change, restrict, suspend, or discontinue individual features of the Service; where possible we will give advance notice of material changes.
5. Your content and rights to it
- Your content belongs to you. Rights to uploaded photos, videos, and captions remain with you (or the person who owns them).
- You grant us a limited, non-exclusive, royalty-free license to store, process (including creating reduced copies/previews), reproduce, and display your content solely to provide you the Service and to show it to the members you invite. We do not use your content for advertising and do not share it with third parties beyond what is needed to run the Service.
- We do not use users' photos, videos, or other content to train artificial-intelligence models, nor do we share it with third parties for that purpose.
- You warrant that you have the right to upload this content and that it does not infringe the rights of third parties.
- We recommend keeping your own backups of important photos — the Service is not the sole storage of your memories.
6. Content review
We do not review users' content manually, except in the following cases:
- a user's request to customer support;
- a report of a violation of these Terms;
- compliance with applicable law.
7. App license
We grant you a personal, non-exclusive, non-transferable license to use the app under these Terms. You may not copy, modify, reverse-engineer, decompile, or distribute the app or its parts without our written consent.
8. Acceptable use (prohibited actions)
When using the Service, you may not:
- upload illegal content, including any child sexual abuse material (CSAM) — this is strictly prohibited and reported to the competent authorities;
- infringe intellectual-property, privacy, or other rights of third parties;
- impersonate another person or misrepresent your affiliation with anyone;
- make the album or its content publicly available beyond the purpose of the Service;
- use the Service for illegal activity, harassment, threats, defamation, or spreading malicious code;
- attempt to gain unauthorized access to systems, other accounts, or data; place an excessive load on the infrastructure; or circumvent technical limits or security measures;
- use the Service for commercial purposes without our consent.
Violating these rules may lead to suspension or deletion of your account (Section 10).
9. Subscriptions, billing, cancellation, and refunds
9.1 Free trial
- New accounts include a free trial of 7 days, starting when you register. No payment details are required to begin the trial, and the trial does not automatically convert into a paid subscription: it simply ends.
- The trial is granted by us, not by an app store. It is not an App Store or Google Play introductory offer, it does not appear among your store subscriptions, and nothing is charged when it ends.
- When the trial ends without a subscription, your content is not deleted and remains visible to you and to the people you invited. Adding new Moments, uploading photos, changing the child's avatar and sending new invitations require an active paid subscription.
- Trials that started before July 31, 2026 remain valid until their original expiration date. Accounts created between July 31 and August 28, 2026 were created without a trial and require a subscription to add content.
9.2 Where you buy: two purchase channels
A subscription can be purchased through either of two channels. The channel you use determines which billing platform processes the purchase, where you manage renewal, and which cancellation and refund procedures apply:
- On the web — through our checkout. Payments are handled by Armitage Labs OÜ, trading as Creem, which acts as the Merchant of Record and contractual seller for payment processing, invoicing, tax handling, refunds, and chargebacks. The Creem Buyer Terms and Creem Privacy Policy also apply to checkout and payment processing.
- In the iOS or Android app — as an in-app purchase billed through Apple (App Store) or Google (Google Play). The store collects the payment and administers the transaction under its own terms. The contractual seller and Merchant of Record can vary by storefront, territory, and the applicable platform agreement; your store receipt and the store terms identify the parties for your particular purchase. Depending on those rules, Apple or Google may act as seller or Merchant of Record, or as an agent or marketplace service provider for us as the developer and principal.
The app shows which channel your current subscription is billed through. While any subscription of yours is live, we do not offer you a new purchase, so that you do not end up paying twice for the same access in two different channels.
9.3 Price
- The price that applies is the one shown to you in the app or at checkout at the time of purchase, together with the billing period and any taxes shown there.
- On the web, the current base price is USD 7.99 per month or USD 79 per year, depending on the plan you select. Applicable taxes may be calculated or added at checkout.
- In the app stores, the price comes from store price tiers: your local currency, rounding, and local taxes are applied through the relevant store, so the amount shown and charged there may differ from the base price above.
9.4 Renewal and cancellation
Paid subscriptions renew automatically for successive billing periods of the plan you selected until canceled.
- Web (Creem): you may cancel at any time through the subscription management flow in the app. Cancellation takes effect at the end of the current paid billing period: you keep paid access until then and will not be charged for the next period.
- App Store / Google Play: use the store's customer-facing subscription management — use Apple Subscriptions or, on iOS, Settings → your Apple Account → Subscriptions; on Android use Google Play subscriptions or Google Play → Payments & subscriptions. The current Lovements app does not submit a developer-initiated cancellation when you contact support or delete your Lovements account, so neither action by itself stops renewal. Cancel before the next renewal and follow any timing requirement shown by the store. If we explicitly confirm that we processed a Google Play cancellation through an available developer tool, that confirmation controls; otherwise, treat the subscription as active until the store shows it as canceled.
9.5 Changing between the monthly and yearly plans
- Web (Creem): you may switch plans at any time through the subscription management flow. A plan change takes effect immediately: the current billing period is refunded in full, and the new plan is charged and starts at once.
- App Store / Google Play: where plan changes are available, use the store's subscription settings or the store purchase flow offered in Lovements. The platform calculates any credit, proration, or new billing date under its own rules, which we do not control.
9.6 Refunds
Except where required by applicable law, subscription payments are non-refundable once your access to the paid Service has begun.
- Web (Creem): Creem may nevertheless process a refund or chargeback where required by law, payment-network rules, or its risk-management procedures.
- App Store: refund requests are submitted to and decided by Apple under Apple's policy, including through reportaproblem.apple.com. Lovements cannot issue an App Store refund directly.
- Google Play: refunds follow the Google Play refund policy. Depending on the timing and circumstances, Google may decide the request or Lovements may be able to process an eligible refund using Google Play developer tools. If Google directs you to us, contact support with the order information and we will consider the request under that policy and applicable law.
Contacting us about a store purchase does not pause or extend any deadline the store applies to refund requests.
9.7 Deleting your account does not cancel a store subscription
- If you purchased on the web, deleting your account also cancels your Creem subscription.
- If you purchased through the App Store or Google Play, the current Lovements account-deletion flow does not submit a cancellation and therefore does not by itself stop renewal or future store charges. Cancel through the store's subscription management before deleting the account (Section 9.4). Keep your store receipt or order identifier if you may later need billing support.
9.8 Price changes and the end of a subscription
- We will give reasonable advance notice of material price changes. A changed price will apply no earlier than the next renewal after that notice, subject to applicable law. Apple and Google apply their own notice and consent rules to price changes for store subscriptions.
- If your subscription ends, your content will be retained for a limited grace period to allow you to reactivate your subscription or export your data. After this grace period, your content may be permanently deleted. You may delete your account sooner under Section 10.
10. Account deletion and suspension
- You may delete your account at any time. The deletion procedure and consequences for data are described on the "Account and Data Deletion" page and in the Privacy Policy.
- We may suspend or delete an account if you violate these Terms, in the case of illegal content, or as required by law.
11. Disclaimer of warranties
The Service is provided "as is" and "as available." To the extent permitted by law, we make no warranties as to uninterrupted or error-free operation, fitness for a particular purpose, or data preservation. You use the Service at your own risk and are responsible for backing up important content.
12. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or profit arising from the use of or inability to use the Service. This limitation does not apply where such exclusion is prohibited by law (including cases of intent or gross negligence).
13. Governing law and disputes
These Terms are governed by the laws of Ukraine. Disputes that cannot be resolved through negotiation are settled in the courts at the Operator's place of registration, unless otherwise required by the mandatory rules of the law of your country of residence that provide you additional protection as a consumer.
14. Miscellaneous
- If any provision of these Terms is held invalid, the remaining provisions stay in effect.
- Our failure to exercise any right does not constitute a waiver of it.
- These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Service.
